Sellers Policy

Short legal notes

This policy is applied to all sellers/vendors and all products listed on Nylcos, and it’s part of the Terms & Conditions of Use and is incorporated by reference. By opening a shop or listing items on Nylcos, you agree to this Policy, the Terms, the Privacy Policy, and the Refund & Return Policy.

Platform Role & Ownership

Except for items sold by the Nylcos Marketplace Store, Nylcos operates solely as a platform connecting buyers with independent sellers. Nylcos is not the seller of record, does not take title to seller-owned items, and does not manufacture, store, or inspect those products.

1) Who can sell on Nylcos

  • Age & identity: Sellers must be 18+ years or older and be able to complete any required identity and tax verification (e.g., SSN/EIN, W-9/W-8).

  • Authority: If you sell as or for a business, you have authority to bind that business and will comply with all applicable laws and taxes.

  • Accuracy: Provide accurate onboarding details and keep them up to date (name, business name, address, payout info).

2) Allowed items

Nylcos is a U.S. marketplace focused on tangible goods that can be legally and safely shipped via USPS/UPS/FedEx. Allowed items must comply with all laws, carrier rules, and this Policy.

General types

  • New items

  • Pre-owned/used items (clearly described)

  • Vintage goods

  • Refurbished or repaired items (workmanship disclosed)

  • Handmade and small-batch products

Categories

  • Fashion & Clothing

  • Health & Beauty (non-prescription; sealed when required)

  • Accessories

  • Baby & Kids (non-recalled; compliant with children’s product safety rules)

  • Home Living & Appliances

  • Sports & Travel

  • Electronic & Accessories (consumer-grade; compliant)

  • TV & Home Appliances

  • Books

  • Garden

If a category requires special compliance (e.g., children’s products, lithium batteries), the seller is responsible for meeting all labeling, packaging, and shipping restrictions.

3) Listing standards (quality & accuracy)

Sellers must maintain truthful, buyer-ready listings:

  • Accurate titles, descriptions, categories. Clearly state the condition: New / Like New / Used / Vintage / Refurbished, and disclose defects, wear, missing parts, modifications.

  • Real photos. Use your own images of the actual item (or accurate representative photos when appropriate). No deceptive edits; show key angles/defects.

  • Pricing & fees. The listed price must match checkout. Shipping/handling must be reasonable and transparent.

  • Inventory. List only items you own or are authorized to sell. Keep quantities accurate; promptly unlist sold-out items.

  • No off-platform steering. Do not use listings or messages to divert buyers off Nylcos to transact elsewhere.

  • No IP infringement. Counterfeits and unauthorized use of trademarks/copyrights are prohibited (see Section 5).

Nylcos may hide or remove listings that are misleading, low-quality, or non-compliant.

4) Product condition & category guidance

  • Electronics / TV & Home Appliances: Must be factory reset, unlocked, and include stated accessories. Disclose battery health if relevant. Evidence of tampering or locks can void eligibility.

  • Health & Beauty: Unopened and sealed unless the listing explicitly allows otherwise and complies with hygiene and safety rules.

  • Fashion & Clothing / Accessories: Unworn, unwashed, tags attached when sold as new.

  • Baby & Kids: Must comply with children’s product safety regulations; do not list recalled or unsafe items.

  • Home Living & Appliances / Garden: Items that require installation must be unused and include all parts/hardware when listed as new.

  • Books: Disclose any markings, missing dust jackets, or damage.

5) Authenticity & intellectual property

  • Sellers are require to only list authentic items.

  • Counterfeits/“replicas,” unauthorized branded goods, bootlegs, and listings that infringe any trademark, copyright, or other IP are strictly prohibited.

  • Rights holders may submit reports; Nylcos may remove listings and take action against repeat infringers.

6) Prohibited items (illustrative, not exhaustive)

You may not list, sell, or attempt to sell:

Illegal or restricted items

  • Items illegal under U.S. federal, state, or local law; stolen property; items acquired unlawfully; items barred by import/export or sanctions rules.

Weapons & dangerous goods

  • Firearms, ammunition, explosive materials; fireworks; certain prohibited knives; weapon components; items encouraging violence.

Drugs & medical items

  • Illegal drugs, controlled substances, prescription medications, medical devices/supplies requiring licensing or approvals unless fully compliant.

Hazardous, recalled, or unsafe

  • Toxic/corrosive chemicals; industrial hazardous materials not permitted by consumer carriers; items on recall lists; products violating consumer safety standards.

Adult/explicit content

  • Pornography, sexually explicit materials prohibited by law or card network rules; exploitative content.

Hate, violence & discrimination

  • Items promoting hate groups, terrorism, or illegal discrimination; content intended to harass or incite violence.

Financial/identity items

  • Credit cards, bank accounts, full identity documents (e.g., passports, SSN cards), or access devices.

We may take action to classify other items as prohibited to protect users and the platform.

7) Shipping, packaging & minimum handling times

  • Handling time (dispatch): Once you receive an order, items should be shipped within 3 business days of cleared payment unless your listing states a different timeframe. Made-to-order or pre-order items must disclose lead times.

  • Carriers: Use reliable carriers (e.g., USPS, UPS, FedEx) and provide valid tracking whenever possible. Ship to the order address.

  • Packaging: Pack safely and compliantly (hazard disclosures, battery rules, fragile protection).

  • Address changes: If the buyer changes the address after purchase, update via order tools or cancel and re-order.

Frequent late shipments, missing tracking, or non-delivery may lead to penalties or account action.

8) Returns, refunds & disputes (summary)

  • The Refund & Return Policy (7-day window) sets the minimum standard marketplace-wide. If your shop policy is more generous, your policy applies.

  • Buyers should report abuse, request return to the seller first for order issues. If issues remain unresolved, buyers may escalate to Nylcos at support@nylcos.com.

  • Sellers must cooperate with return requests, evidence gathering (photos, tracking), and payment processor or carrier claim procedures.

  • Nylcos Overrides (exceptional cases): We may require a seller to accept a return or refund without notwithstanding the seller’s policy, only if we confirm:

    • Counterfeit or prohibited item

    • Never shipped / no first carrier scan

    • Significantly not as described (material misrepresentation)

    • Undisclosed damage/defect with timely evidence

    • Clear violation of Nylcos Vendor & Product Policy or other platform policies

Title & Risk of Loss (recap): For seller-owned items, risk typically passes after the first carrier acceptance scan and upon delivery per carrier events; misrepresentation or poor packing can keep responsibility with the seller. For Nylcos-owned listings, we are the seller and responsible of record and holding.

9) Communications, reviews & conduct

  • Sellers must respond to buyer messages/issues within a reasonable approximate time (24–48 hours recommended).

  • Sellers and buyers should not harass, use hate speech, or any retaliation. No incentives or coercion for positive reviews.

  • We may remove content that violates conduct rules or exposes users to risk.

10) Compliance reminders

  • By selling on Nylcos, it is required that you follow all U.S. laws, carrier rules, and category-specific compliance (including children’s product safety, battery shipping, labeling).

  • Maintain accurate records for tax and warranty obligations.

  • Do not attempt to bypass platform, legal, or carrier restrictions.

11) Enforcement

Depending on the severity and the history of a violation, we may:

  • Remove or hide listings

  • Limit visibility or features

  • Delay or withhold payouts; place reserves

  • Suspend or terminate accounts and related accounts

  • Cancel transactions when appropriate

  • Report serious violations to authorities, carriers, or payment processors

We may act without prior notice to protect users, comply with law, or safeguard the platform.

12) Reporting violations

If you suspect any policy violations (including counterfeit, prohibited items, or safety issues, etc), feel free to report the alleged violation to privacy@nylcos.com
with listing URLs and evidence.

13) Changes to this Policy

We may update this Policy at any time to reflect the company’s rules and standards. When we do, we will revise the publication date. Your continued use of Nylcos after any policy updates constitutes acceptance of the revised terms.
